An 11-year-old Oviedo boy appeared before a judge Tuesday after police cited him on Labor Day for riding what officers described as an unregistered motorbike he was too young to operate.
Cade Kirchner stood in court alongside his parents and attorney for a hearing that lasted less than two minutes. His attorney entered a not guilty plea on his behalf.
Kirchner is charged with one count of misdemeanor failure to register his motorbike, according to the citation. In body camera video obtained by News 6, an officer can be heard questioning the child about why he was riding the motor bike. Oviedo police said the vehicle was not a standard e-bike and could reach speeds of up to 50 mph.
“He’s driving a dirt bike, 4,500 watts, 50 miles an hour,” an officer said.The video shows Cade being fingerprinted, ticketed and issued a court summons after the Labor Day incident. In the footage, an officer tells him he is receiving one citation but could have faced more.
“So you’re getting one ticket today. OK? You could have gotten six criminal violations, but I’m giving you one,” the officer said.
The officer explained the process to the child, who had no prior criminal record according to court documents.
“You know, this is a motorcycle, you know, you can’t be riding it, all right?” the officer said. “So just because you signed this ticket doesn’t mean you’re admitting to any guilt. OK, buddy?”
After the hearing, Cade’s father, Chris Kirchner, criticized the process and that the court proceedings would be ongoing.
“How ridiculous that he had to miss school for that,” Chris Kirchner said.
Samuel Filler, the attorney representing Cade, said he expects the case to be resolved soon.
“We will get it all resolved, no doubt in my mind,” Filler said.
The judge told Cade he must return to court Dec. 2 for the case to continue.
